New Hampshire Enacts New Law on Health Privacy

New Hampshire Governor John Lynch recently signed into law, HB 619, an Act Relative to Medical Records and Personal Information. The new measure will provide individuals with more privacy rights and control over the use of their personal health information for commercial purposes. Specifically, it requires than an individual’s consent be obtained before communications are made to such individual for alternate treatments, therapies, providers or sites of care, but it makes an exception for communications that are made by the individual’s own healthcare provider. The bill also requires patients to be given an opportunity to opt-out of fundraising using protected health information prior to any solicitation.
